Dion’s comments were published in Law360, 2 July 2026.
“As the wheels wobble on MiCAR registrations the licensing crunch has certainly provided an opportunity in that firms may choose to set up in the U.K. instead of the European Union.
“If the UK is able to make the most of this opportunity the hope for crypto firms operating from the UK is whether there will eventually be equivalence with the EU to allow the passporting of services to EU customers – this is a political matter and one to watch.
“Currently, MiCAR does require an EU presence for crypto firms operating in Europe, but that might not always be the case. More flexibility of jurisdiction may be possible for the U.S. where the UK-US taskforce is considering cross-border opportunities. But it is hard to argue for the position on equivalence in the absence of regulations, and so any developments are likely to take place after the FCA regime is live in 2027.”
